The Privacy Policy is a part of the Site’s Terms of Use Agreement, which is binding on all Customers. 

   Unless specified otherwise on the Site, Customers must be at least 18 years of age and a legal resident of the area used in their billing information before participation in any activity that requires the submission of Personal Information.    We reserve the right to monitor and edit any Personal Information about our Customers, including information about the use of website activities and services and the contents of Customers’ email and messages for internal purposes and when necessary, to disclose to law enforcement personnel, and/or the employer and/or Internet Service Provider of a user that is not in compliance with the Terms of Use Agreement. We will take such measures if we believe it is necessary to protect the security and operations of this Site.

   Children’s Privacy Policy
   Although persons of all ages may visit our Site, we do not knowingly or intentionally collect Personal Information from children under the age of 18 and will automatically reject and delete the registration and/or entry of any person we believe in good faith to be underage.

   Email Policy
   We do not generally keep email correspondence, except for those e-mails that relate to club membership interest and activities and online educational  programs.

   E-Commerce Policy
   This Site sells goods and/or services and we will request Personal Information that includes your credit card or other payment information, full name, billing and shipping address, email address and telephone number and any such information that is required to fulfill your order and to communicate    with you regarding your order. Sensitive Personal Information such as credit card account numbers will be collected though a secured Internet connection generally via SSL or S-HTTP protocols. We may use your Personal Information, (but not your credit card number) to contact you about future products, services and/or discounts. We will only use your credit card number to complete the specific transaction you requested.

 Blog and Other Public Forums Policy
   At some time in the future, this Site may offer user interactive activities such as Blogs, Webinars, Chatrooms, Message Boards, and/or other Public Forums (”Social Networks”). We will not share any Personal Information that is entered into the Public Forum registration and/or correspondence areas with Advertisers.

   Cookies and Image Tags

Membership Site users can change their information any time by simply emailing our Support/Services Department. Customers may review, update or delete Personal Information collected by the Site. We reserve the right to deny access to any user if we believe there is a question about their    identity.    By providing personal and/or credit information to fixmycredit-please.com, you agree to the following Terms of Service:

   This Terms of Service document (this “Agreement”) constitutes a legally binding contract between The Credit Manual, LLC dba fixmycredit-please.com (”Free Credit ) and the person or organization (the “Customer”) who submits an order for Services/Products or who pays for Services/Products from fixmycredit-please.com. We may change this Agreement  at any time by posting a revised version of the Agreement on our website and such change will be effective at any time after the Customer is advised of the change and continues to use or pay for our Services/Products.

    1. Services and Products
   Fixmycredit-please.com will provide the Services/Products ordered by the Customer, subject to all of the terms, conditions and limitations applicable to the Services/Products set forth on the fixmycredit-please.com website. The Customer will pay for the Services/Products at the price indicated in the order. fixmycredit-please.com may change the prices for the Services/Products at any time and any such change in prices will be effective immediately (within 24 hours) after fixmycredit-please.com posts the change on its website. All fees collected under this Agreement are fully earned when due and refundable only under Terms set forth at the Point of Sale. All costs due under this Agreement must be paid in    United States dollars via credit card or other payment methods acceptable to fixmycredit-please RepairStrategies.com. The Customer agrees to provide their true and accurate name in form and spelling; their true mailing and street addresses (as appropriate); their own telephone number(s) and other reasonable contact information and to update such contact details as they may change.

    2. Shipping and Receiving
   Customers CAN EXPECT TO receive Products 4 to 6 weeks after orders are placed and processed. services are available immediately after customer payment is processed.

   3. Acceptable Use
   The Customer may use our Services/Products only as in accordance with this Agreement; the applicable laws in the United States and the applicable laws of any other legal jurisdiction. Customer agrees not to use the Services/Products in any manner that would violate the fixmycredit-please.com Acceptable Use Policy. In addition, the Customer agrees that it will not use the Services/Products to:

  • Engage in any illegal or fraudulent activity;

  • Violate the patent, copyright, trademarks, trade secrets or other intellectual property rights of fixmycredit-please.com or any third party;

  • Sell or distribute content illegally or without written authorization from The Credit Manual, LLC and/or fixmycredit-please.com; and/or publish or distribute in any manner any content in a harassing, libelous, defamatory, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable manner to or in the opinion of fixmycredit-please.com;

  • Engage in any activity considered to be in direct or indirect competition with The Credit Manual, LLC, fixmycredit-please.com or any of its Agents

        4. No Guarantee of Results
       The Customer acknowledges that fixmycredit-please.com does not guarantee or imply any specific degree of success from our Services/Products. The Customer also acknowledges that Services/Products may be subject to accidental website interruption or disruption, loss during mailing/shipping of products and/or other conditions beyond the control of fixmycredit-please.com that may prevent or delay the proper operation or delivery of Services/Products to our Customers and for which fixmycredit-please.com will bear no personal or professional responsibility. The Customer irrevocably covenants, promises and agrees to indemnify fixmycredit-please.com and its assigns and to hold all harmless from and against any and all losses, claims, expenses, suits, damages, costs, demands or liabilities, joint or several, of whatever kind or nature that they may sustain or to which they may become subject arising out of or relating in any way to the use of the Services/Products, including, without limitation, in each case attorneys’ fees, costs and expenses actually incurred in defending against any such claims or enforcing the prerogatives of fixmycredit-please.com under this Agreement.

        5. Use of Customer Data
       Customer agrees that fixmycredit-please.com may use data collected from the Customer only as permitted by the fixmycredit-please.com Privacy Policy and fixmycredit-please.com agrees to use such data only as permitted by our Privacy Policy, the terms of which are incorporated herein and by this reference as if fully stated herein.

       Certain of these Services/Products may include additional third-party products or services that require the Customer to accept the terms and conditions of the third party or to pay additional fees to such third party. Customer agrees that it is wholly responsible for any such third party terms and conditions and third party fees.

        6. Billing and Refunds
       Services/Product processing will commence on the date Customer’s order is accepted by, and payment for said Services/Products) are received by, fixmycredit-please.com (the ”Effective Date”). Certain services, such as online club membership will continue on the basis of successive billing periods of 30 days (with the first day of each billing period being a ”Billing Date”) thereafter until terminated by either party. fixmycredit-please.com will charge the Customer’s credit card on each Billing Date for the billing period beginning on that date. If funds or not available or fixmycredit-please.com is otherwise unable to collect the fees when due, fixmycredit-please.com may continue to submit charges on the Customer’s credit card from time to time until all fees due are paid. fixmycredit-please.com may suspend or stop all or any portion of our Services/Products at any time when fees are due and unpaid.

       Any fees due under this Agreement are net of any sales or use taxes, all of which are the sole responsibility of Customer. Customers who purchase Services/Products may receive a full or pro-rated refund for terminating their Services/Products as follows:

        Sixty Minute Money-Back Guarantee – For Workshops, Boot Camps and Other ‘In Person’ Training Venues – A Customer may receive a refund of 100% of the amount paid in advance for any given ‘in person’ type training IF that customer notifies attending staff that they are no longer interested in the training and they return all materials received for the training within 60 minutes of the beginning of the workshop/boot camp/training.

        Thirty Day Money-Back Guarantee – A Customer may receive a refund of 100% of the amount paid – minus processing, handling and shipping costs - if the Customer notifies our Services Department by email or makes a direct phone call to our Customer Services/Support Department within thirty (30) days or less after the Effective Date.

   Please note: Customers who have exceeded the 30-day trial period, are not entitled to a refund.

   7. Termination
   Credit Insiders ClubTM Members may terminate their Website Membership at any time by giving Credit Consulting Group, LLC notice at least thirty (30) days prior to their next Billing Date.

   Fixmycredit-please.com may also terminate this Agreement at any time by giving a Customer thirty (30) days prior notice. In addition, fixmycredit-please.com may terminate this Agreement immediately and without prior notice if, in the judgment of fixmycredit-please.com, the Customer is found in breach of any part of this Agreement. Following termination the Customer will have no right to use or access any of fixmycredit-please.com Services or Products. In its discretion, fixmycredit-please.com may permit a Customer to recover personal data following termination and after payment of additional fees.

    8. Notice
   Fixmycredit-please.com may give notice to Customer of any matter under this Agreement (a) orally, by calling the Customer or their representative or by leaving a voicemail for Customer or their representative at the telephone number in Customer’s profile, (b) by email to the email address previously provided by Customer, or (c) by regular mail to Customer’s mailing address in Customer’s profile. A Customer may give notice to fixmycredit-please.com by regular or certified mail to the following address:

   A Customer may also give notice of cancellation by calling fixmycredit-please.com at 313-835-1800 and ask for the Customer Support/Service Department.

    9. Miscellaneous
   Indemnification. A Customer will indemnify and defend fixmycredit-please.com and its Agents against any third-party claim, action, suit, or proceeding arising out of or relating in any way to any alleged breach of this Agreement by the Customer. fixmycredit-please.com will indemnify and defend Customer against any third-party claim, action, suit, or proceeding alleging any breach of this Agreement by fixmycredit-please.com. In connection with any request for indemnification under this Agreement, the indemnified party must: (i) give the indemnifying party prompt, written notice of any claim, action, suit, or proceeding for which the indemnified party is seeking indemnity; (ii) grant control of the defense and  settlement to the indemnifying party; and (iii) reasonably cooperate with the indemnifying party at the indemnifying party’s expense.

   Limitation of Liability. IN NO EVENT WILL THE LIABILITY OF fixmycredit-please.com UNDER THIS AGREEMENT EXCEED THE AMOUNT PAID BY CUSTOMER DURING THE THREE (3) MONTH PERIOD BEFORE THE DATE ON WHICH SUCH LIABILITY AROSE. IN NO EVENT WILL FIXMYCREDIT-PLEASE.COM BE LIABLE FOR ANY (A) LOSS OF SERVICE/PRODUCT USE, LOSS OF DATA, OR INTERRUPTION OF MEMBERSHIP WEBSITE ACTIVITY OR (B) INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND WITHOUT LIMITATION, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF FIXMYCREDIT-PLEASE.COM AND ANY OF ITS AGENTS/AFFILIATES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CUSTOMER ACKNOWLEDGES THAT THESE LIMITATIONS ARE AN ESSENTIAL ELEMENT OF THIS AGREEMENT, AND ABSENT SUCH LIMITATIONS, FIXMYCREDIT-PLEASE.COM WOULD NOT ENTER INTO THIS AGREEMENT.

   This Agreement shall be governed solely by the laws of the State of Michigan, excluding its principles of conflicts of laws. Any action under or relating to this Agreement shall be brought solely in the state and federal courts located in Michigan, with sole venue in the courts located in Wayne County, and each party hereby submits to the personal jurisdiction of such Courts. Each party agrees that its performance under this Agreement shall in all respects conform to all applicable laws, rules, and regulations of the United States. Customer may not assign this Agreement without the prior, written permission of fixmycredit-please.com. Any purported assignment in violation of this statement will be void and without any effect. This Agreement may not be modified or amended except in writing wherein it is signed by all relevant parties. Any purported oral modification or amendment of this Agreement in derogation of the foregoing shall be without any effect. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to fixmycredit-please.com Services, Products or this Agreement. Neither party may waive any right hereunder except expressly and in writing. This Agreement is the entire agreement between the parties with respect to this subject matter, and it supersedes all prior and contemporaneous discussions, negotiations, communications, and agreements with respect thereto

   Due to new Federal laws, we will not accept any e-mail address that is to be used for messages sent directly to a mobile device. Any such e-mail address will be rejected. Messages that are forwarded to a PDA, such as a Blackberry or Palm Pilot, or a cell phone from an e-mail address that is not directly associated with a mobile device are not affected by this policy.
